At Shivam Advt Agencies, we are committed to delivering exceptional creative advertising and marketing services. We understand that sometimes plans change. This Refund and Cancellation Policy outlines the circumstances under which refunds may be issued, cancellation procedures, and your rights as a client. By engaging our services, you agree to the terms below. This policy applies to all services including graphic design, digital marketing campaigns, video production, web development, print advertising, and brand strategy consulting.
For all custom projects, we require a 50% advance deposit before work commences. This deposit secures your project slot, covers initial research, concept development, and resource allocation. The deposit is partially refundable only under specific conditions outlined in Section 3. The remaining 50% balance is due upon final approval, before delivery of final high-resolution files, source codes, or campaign launch.
Our Promise: If we fail to start your project within 5 business days of deposit (without prior notification), you are eligible for a full refund of the deposit.
3.1 By Client (Before Work Commences): If you cancel within 48 hours of making the deposit and no creative work (including research, mood boards, or drafts) has been initiated, you will receive a 90% refund (10% deduction covers administrative & payment gateway fees). After 48 hours or if initial concepts have been shared, deposit becomes non-refundable.
3.2 By Client (After Work In Progress): If you cancel after work has begun (e.g., drafts presented, strategy outlined, video storyboard created), refunds are calculated on a pro-rata basis. We will invoice for the percentage of work completed (minimum 30% of total project value). Any remaining deposit balance will be refunded. No refunds if project is 70% or more complete.
3.3 By Shivam Advt Agencies: In the rare event we are unable to deliver the agreed scope due to internal constraints, you will receive a full refund of all payments made for that project. We will notify you immediately.
3.4 Mutual Agreement: Both parties may agree to terminate a project with a refund amount proportional to uncompleted deliverables, documented in writing.
The following are not eligible for refunds under any circumstances:
We take pride in delivering high-quality creative work. If you are unsatisfied with the initial concepts, our process includes revision rounds (as specified in your project estimate). If after utilizing all revision rounds you still believe the work does not meet the scope, we may offer a partial refund (up to 30% of project fee) OR the option to terminate with a fair adjustment. Refunds are not provided simply because of subjective aesthetic preferences; we will work diligently to align with your brand vision.
To request a cancellation or refund, you must submit a written request via email to support@shivamadvtagencies.com with the subject line "CANCELLATION REQUEST - [Project Name/Invoice Number]". Your request must include:
We will acknowledge your request within 2 business days and process eligible refunds within 7-10 business days via the original payment method. Bank/wire transfers may take additional time depending on financial institutions.
We commit to delivering projects within the timelines agreed in the Statement of Work (SOW). If we miss a mutually agreed final deadline by more than 10 business days without a valid reason (client delays, force majeure, or third-party outages), you may request a 10% discount on the project fee or a partial refund proportional to the delay. This does not apply if delays are caused by client's failure to provide feedback, assets, or approvals on time.
Shivam Advt Agencies shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, internet outages, government actions, labor disputes, or supplier failures. In such events, we will work with you to reschedule or offer a pro-rated refund if the project cannot be completed within a reasonable extended timeframe.
We encourage open communication. If you believe a refund is warranted, contact us first. Filing a chargeback with your bank without prior discussion violates our agreement and may result in suspension of services, legal action, and reporting to credit bureaus. Any disputed amounts resolved in our favor will be subject to a ₹2,500 + GST administration fee.
